Artista.art Pisino aims to create links between local artists and a diverse audience. On this platform, artists and art galleries can exhibit their creations and even open their own online shop. Discover the different artist categories on www.artista.art
Terms and conditions of use :
These terms and conditions govern your access to all content, products and services available on the website: www.artista.art.
The service and your use of it are operated by Artista.art Pisino;
CH-ID: CH-645-4125598-1 2000 Neuchâtel – Switzerland.
Your access to our services is subject to our acceptance, without modification, of all terms and conditions contained herein and all other operating rules and policies published by Artista.art.
Please read the agreement carefully before accessing or using our services. By accessing or using our services, you agree to be bound by these terms and conditions. If you do not agree to any part of the agreement, you may not access or use our services.
Subject to terms and conditions :
Users of the www.artista.art website connect to enter into direct relationships, whether to buy or sell works of art. Transactions take place exclusively between buyer and seller, without interference from Artista.art. Artista.art declines all responsibility for the sale of works of art by sellers and cannot be held responsible for contractual commitments between the parties.
Designation of the parties :
The artist is “the seller”: An artist is a natural person who creates, cultivates or masters an art, a skill or a technique, and who is distinguished by his or her creativity, poetry and the originality of his or her production, actions and gestures. An artist is a person or company that offers its works of art and/or services for sale.
www.artista.art: Online platform operated and made available by Artista.art Pisino on which the artist has a dedicated space in the directory, as well as a shop and products.
Visitor: a user who visits the www.artista.art website to keep abreast of new artistic trends. A visitor can become a potential buyer.
Buyer: a user of the www.artista.art platform. In other words, a potential buyer of the works of art and services offered.
Scope of application:
Artista.art offers its products described on www.artista.art/services and enters into a contract with the artist relating to one or more products on the site, which are entitled “personalised services”;
The contracting party acknowledges having read these general terms and conditions prior to any registration, order or use of the online platform www.artista.art and accepts these general terms and conditions in their entirety, without any possibility of modification or waiver.
The general terms and conditions form an integral part of the services and products offered by the service provider via its online platform www.artista.art.
The use of certain services or products may imply acceptance by the party concerned of specific conditions which may apply cumulatively with the general conditions.
Modification of the General Terms and Conditions
Artista.art reserves the right to modify the GTC and the registration conditions at any time. Amendments will be communicated to the artist in an appropriate manner to enable him/her to become aware of them (e.g. in the newsletter, by e-mail or in the space reserved for artists).
The artist has the right to terminate the contract if the modifications lead to substantial additions or the restriction of his rights. If the customer does not terminate the contract within 15 days, he is deemed to have accepted the modifications.
Definitions and terminology
“Registration form” :
an online registration form that the artist must complete to obtain accreditation.
“The directory of artists :
directory of artists containing information such as contact details, achievements and services offered by the artist, facilitating visibility and contact with the public
“Shop Artist:
is the “Boutique des Artistes” space, which offers artists a dedicated platform for marketing their creations or artistic services online, while receiving payments directly into their bank account. Before they can open their own shop, artists must first register in the artists’ directory;
“Personalised services provided by Artista.art”:
These are personalised services for artists, enabling them to sell their works of art and services. Details can be found on the following page: artista.art/services.
“Works of art:
Artistic creations, known as “works of art”, refer to the material creations offered for sale by various artists such as painters, sculptors or craftsmen.
“Artistic services
refers to artistic services, i.e. services offered by artists, such as musicians, magicians, storytellers, etc.
“Content” :
All published information and data relating to the commercial artist’s offer and its promotion, such as company name, address and contact details, opening hours, photographs, images, texts, graphics, logos, audio tapes, videos, advertising content, and other data, attributes of other data, attributes, keywords, search terms, are taken into account.
Content may be provided by the artist, Artista.art or third parties (including links to external content and its integration via links or iFrames) and may come from a variety of sources.
“Activation date” :
the date on which the artist’s or gallery’s registration form was completed and validated by artista.art.
“End of contract” :
the date on which an artist’s or gallery’s contract is terminated.
“Artista.art’s service partners :
refers to related companies and other third parties that Artista.art uses to provide its services. Artista.art is used to provide the Services.
“Duration of Artista.art’s personalised services:
means the period of time from the activation date during which the Artist is authorised to use Artista.art’s Custom Services and during which the Artist may use a Service.
The artista.art services are as follows:
1. Artist directory :
We publish your showcase for all the artists in the categories presented at https://artista.art;
This area includes :
– Your contact details
– Your website, your e-mail
– Links to your social networks
– Description of the artist’s skills
– Photo of you or your artistic activity
– Our tool for sharing your publications with social networks
– Putting your content online in accordance with the contract
– Helpdesk
– Your presentation video
Rates and billing for the artist directory service :
The subscription applies to artists offering the following services: Acrobats, Choirs, Comedians, Storytellers, Dancers, DJs, Comedians, Jugglers, Magicians, Make-up artists, Musicians, Bands, Orchestras, Poets, Theatre groups.
Annual subscription to the artists’ repertoire : CHF 60
Lifetime subscription to the artists’ repertoire : CHF 240.00
Cancellation period: 3 months’ notice
2 The shop, the artist’s sales space
This area includes :
– The artist’s administration console page, the CRM dashboard.
– Your e-commerce page (shop) with your products and services
– Managing artwork and shipments
– Our secure payment tool
– Sales prices and item numbers for each of your works of art
– Detailed description of your work
– Photos of your work (articles)
– Your bank details, your IBAN for the collection of the works sold
– Automatic notification of each sale
– Artista.art actively promotes the shop’s products on social networks
– Referencing, visibility and promotion & sales support
– One article per year in the site’s blog and on social networks
– A helpdesk
Rates and billing for the service, the artist’s shop :
1.Artists who sell work in their own shop:
The subscription is aimed at artists who supply works of art, such as craftspeople, fashion designers, mosaic artists, puppeteers, photographers, painters and sculptors.
Annual boutique subscription: CHF 60.00;
10% commission per work sold
Cancellation period: 3 months’ notice
Using the service: Artists must first be registered in the artist directory;
2.Artists who sell artistic services in their own shop:
The subscription applies to artists offering the following services: Acrobats, Choirs, Comedians, Storytellers, Dancers, DJs, Comedians, Jugglers, Magicians, Make-up artists, Musicians, Bands, Orchestras, Poets, Theatre groups.
In accordance with article 2, paragraph 1 of the Oemol-LSE in Switzerland.
Annual subscription: CHF 60.00
8% commission for artist placement by Artista.art
Cancellation period: 3 months’ notice
Commission on artistic performances in accordance with article 4, paragraph 1 of the Oemol-LSE
Conclusion of the contract
The contract comes into force when the artist completes the online registration form or a contract form offered by Artista.art and accepts the platform’s GTC.
Once Artista.art has approved the registration form and the artist’s details, activation takes effect immediately.
Termination of membership by the artist
Members may cancel their contract (subscription) at any time by sending an email to hello@artista.art. 3 months’ notice is required for the cancellation to be processed;
The cancellation conditions are as follows:
– The artist’s account must be balanced.
– The 12-month subscription is non-refundable.
Intellectual property rights
The intellectual property rights relating to the information presented in the directory and in the shop belong exclusively to the artist and remain in his possession.
Prohibited Content and Activities
When using our services, you agree not to engage in or promote any of the following prohibited activities:
Illegal Activities: Any content or activity that is illegal under applicable local, national, or international laws.
Adult Content: Pornographic or obscene materials, including any content that promotes sexual services or adult entertainment.
Hate Speech and Discrimination: Content that promotes violence, hatred, or discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or any other characteristic.
Fraudulent Activities: Activities that involve scamming, phishing, or any other form of fraud.
Counterfeit Goods: Selling or promoting counterfeit or unauthorized replicas of goods.
Violence and Harm: Content that depicts or promotes violence, self-harm, or harm to others.
Drugs and Paraphernalia: Promotion or sale of illegal drugs, substances, or paraphernalia.
Weapons: Sale or promotion of firearms, ammunition, explosives, or weapons.
Sensitive Information: Sharing of personal, confidential, or proprietary information without consent.
Misleading Content: False, misleading, or deceptive content, including misinformation and fake news.
Gambling: Promotion of gambling, betting, or any related services not authorized by law.
Tobacco and Alcohol: Unlawful promotion or sale of tobacco, e-cigarettes, alcohol, or related products.
Restricted Goods and Services: Any goods or services that are restricted or banned by applicable laws or regulations.
We reserve the right to remove any content or suspend accounts that violate these guidelines without prior notice. Repeated violations may result in permanent account termination.
By using our services, you acknowledge and agree to comply with these terms. If you come across any content or behavior that violates these guidelines, please report it to us immediately.
Privacy policy
We understand that online privacy is important to users of our site, especially when conducting business. This statement governs our privacy policy with respect to users of the site (“visitors or purchasers”).
Personally identifiable information
Any information that identifies or can be used to identify, contact or locate the person to whom the information relates, including but not limited to name, address, telephone number, fax number, e-mail address, financial profiles, social security number and credit card information;

We collect the following additional information from our authorized customers: names, addresses, telephone numbers and e-mail addresses of authorized customers, the nature and size of the business, and the nature and size of the advertising inventory that the authorized customer intends to buy or sell.
